Within this document ("Terms and Conditions") the following definitions apply:
- “Consumer (Not business)": means any person who place an order for purposes unrelated to his business activity.
- "Professional/Company/Trader (Business)": any natural or legal person responsible for ordering products in the exercise of his trade, business, craft or profession.
- "Customer": depending on the situation, a consumer or a professional.
- "Contract/Agreement": means any agreement between Mapel & C and a Customer regarding the purchase by the latter of one or more products, concluded, in any manner.
- "Order": means any proposal relating to the purchase of one or more products, submitted by the Customer to Mapel & C, through the website "Buyleatheronline.com", by telephone or via e-mail.
- "Supplier": means a subject that employs the technology of distance communication called "internet" for the conclusion of distance contracts.
1. Object of the online contract and its definition
“Online purchase agreement" refers to the contract performed remotely that is the legal transaction, related to goods and/or services, concluded between a supplier, in this case Mapel & C Srl. based in Ponte a Egola (PI), Nazario Sauro street, no 51, VAT IT00691170500, and a Customer in the context of a system of remote sale organized by vendor that for this purpose, employs the technology of distance communication called "internet". The contracts will be concluded directly through the access of the Customer to the internet website "Buyleatheronline.com", where, after completing the registration procedures, the Customer can conclude the contract for the purchase of the goods. These Conditions will remain effective until changed by Mapel & C; any changes to the terms and conditions will be effective from the time that will be published on the website.
2. Sales prices
Selling prices of the goods displayed on the website buyleatheronline.com are VAT excluded and taxes will be indicated in the cart at the time of purchase according to the delivery address. The cost of transportation or any discounts will be highlighted in the order summary page that the Customer will take care to see before confirming your purchase. Prices may be subject to updates, the client is invited to ensure, by updating the cart, the final sale price before submitting the relevant order form.
3. Conclusion of contract and general conditions of sale
3.1 Conclusion of contract
The purchase contract is accepted with the exact compilation and the consensus expressed by purchasing "online". The Customer can pay the ordered goods only through the method of payment indicated. The order form will be stored in our database for the period of time necessary for order fulfillment and anyway in respect of terms of law. The Customer can access the order form, consulting the section "Your Account". With the electronic transmission of the order form, the Customer unconditionally accepts the terms and conditions listed on this page. If you do not agree with some of the terms, please do not submit the order form to purchase products. By submitting an order form you confirm, moreover, to know and accept the terms and conditions and the Privacy Policies. Once Concluded the contract, the supplier will send, by electronic mail, a receipt of the purchase order, containing a summary of the information already contained in the order form. Mapel & C Srl will provide a copy of the purchase contract on its website "Buyleatheronline.com". It is recommended to keep a copy of the contract either on paper or electronically.
3.2 Right of supplier (Mapel & C) about sale
The supplier may not accept orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in case of unavailability of the products. In these cases, we will inform the Customer by e-mail that the contract is not concluded and that the supplier has not accepted the order specifying the reasons. Where the products presented on https://buyleatheronline.com, are no longer available or for sale at the time of the last access to the site or the sending of the order form, Mapel & C will communicate, promptly and in any case within thirty (30) days from the day following that of transmission of the order to the supplier, the unavailability of the products ordered. In case of payment of the price, the supplier will refund what paid by Customer.
3.3 Features and products information
We inform the Customer that the product you buy is intended solely for the country in which making the order; therefore, if Customer decides to export the product in a different country, is responsible for placing and he is obliged to follow the regulations and restrictions applicable for export from the country where you purchased the item for import in the country in which he intends to take it. Mapel & C Srl declines any responsibility from now on. The essential characteristics of the products are presented within each product page. The images and colors of products offered for sale on "Buyleatheronline.com" may however not be corresponding to real ones as a result of the Internet browser and the monitor used. Mapel & C also does not warrant the exact correspondence of the product viewed with that received because of the intrinsic characteristics of leather products, that being living matter, is by its nature difficult to standardize in colors and quality.
For the purposes of selling leather, the surface area (expressed in square metres) of the leather is relevant; on the "Buyleatheronline.com" website and in the order confirmation, the "average" size of each product and/or combination is indicated with a possible tolerance of 20%. This means that disputes regarding the dimensions of products that fall within this tolerance range will not be taken into consideration in order to obtain a refund.
If the customer service has contacted the customer in advance and informed him about one or more leathers in his order which are defective or which do not fall within the standards indicated on the product page, providing relevant photos demonstrating the extent of the defect(s), and the customer has confirmed the desire to receive the defective leather, it will no longer be possible to open a complaint once the leather has been received, without prejudice to the possibility of returns with costs borne by the customer for non-customized products.

As regards payment of the goods, related shipping costs, and handling charges you may then use one of the methods indicated in the order form. In case of payment with credit card, financial information (e.g., the number of credit/debit card or the date of its expiration date) will be sent via encrypted protocol (SSL) to suppliers of electronic payment services at distance, without third parties, in any way, accessing to them. In addition, this information will be used by the supplier only to complete the procedures concerning the purchase and to send repayments in the event of a product refunds, subsequently to the exercise of the right of withdrawal, or where it is necessary to prevent or report to police of fraud on https://buyleatheronline.com. The price for the purchase of products, shipping costs and delivery, as indicated in the order form, will be charged immediately in case of payment through PayPal or credit card after the confirmation of the order. In case of payment by bank transfer, the Customer will perform all operations that the payment needs, taking note of the bank details provided during order processing. In case of payment with bank transfer, Mapel & C reserves itself a longer order processing period due to testing times required by this form of payment, in any case less than (30) thirty days as provided by law. In the case of payment by bank transfer, if within 10 days of purchase the Customer doesn’t perform the payment or doesn’t give any notice of the delay, the supplier has the right to cancel the order. In case of cash on delivery, the maximum permitted amount is € 999. Higher amounts confirmed by the Customer with this of method of payment will not be accepted and the Customer will be prompted to choose another form of payment. In the case of payment by credit card too, the Supplier reserves a longer processing period of order due to the longer verification times required by this form of payment, especially with some credit cards (for example American Express).
3.5 Order by telephone
The Customer can make the purchase of the products by contacting Customer service at (+39) 0571 499345, from Monday to Friday from 09:00 to 17:00, as long as they have registered on the site. The Customer can forward the order by contacting Customer service at the number above, giving operators all the data necessary for its conclusion (first name, last name, Email address, billing address and shipping address if it is different from the billing address). The order will be forwarded at the end of the phone and communication, such as contractual proposal within the meaning and for the purposes of art. 1326 of the Italian Civil Code. Upon placing the order will follow the confirmation by Mapel & C which has the right to accept orders or not.
3.6 Delivery times and shipping methods
Mapel & C shall not be liable for failure or delay in delivery if: (a) despite having done so regularly and timely purchase of products covering of the order received, it has not been supplied within the time limits and agreed ways with the supplier; (b) may not be able to make up for the lack of availability of such products, for circumstances not under his control. In any case, in the case where the unavailability of the products does not allow to carry out the delivery within 30 (thirty) days from the submission of the order by the Customer, Mapel & C will refund the same of any advance payment no later than 30 (thirty) days from the day following the day on which the order has been sent. In the event that the purchaser has not followed up or has not followed the instructions of the courier about the delivery or in the event that the delivery was not possible due to the absence or the recipient at the shipping address communicated at the time of purchase, or in the event that the shipment returns to the sender, Mapel & C may withhold the transport costs incurred and the management costs plus any charges and duties. The amount reduced by the aforementioned costs will remain available to the buyer who may request a refund within 90 days or request a new shipment whose difference must be paid in advance. All shipments made by Mapel & C are DAP (Delivered At Place) according to Incoterms standards, therefore they do not include the payment of any import customs duties that remain the responsibility of the consumer. Mapel & C reserves the right (by maintaining a comparable level of service) to use a shipping method or a different courier from the one chosen by the customer during the conclusion of the purchase contract, if the shipment is not compatible with the dimensions accepted by the couriers or additional costs (such as for remote areas) are present, or in the case the courier or shipping method chosen are no longer available. Mapel & C reserves the right to lengthen the preparation time for internal needs and will not be liable for any order delays due to seasonal peaks, holidays or closures, compared to the estimated delivery times indicated at checkout.
3.7 Causes of major force
Mapel & C shall not be liable for failure or delay in delivery due to causes of force major, such as – but not limited to strikes, the public authority measures, rationing or shortages of energy and raw materials, transportation difficulties, fire, flood, flooding. If the force major persists for a period exceeding 30 (thirty) days, either party may withdraw from the contract. In case of cancellation, the Customer shall not be entitled to any indemnity or compensation in any way, without prejudice to the entitlement to the refund of the already paid by way of price for the ordered products.
3.8 Billing and Tax Documentation
Mapel & C, as required by current legislation for distance selling within the European Community, is not obliged to issue any fiscal document against a sale to private consumers (pursuant to Article 24 of Presidential Decree No. 633/72). Furthermore, for the purposes of certifying the fees, it is not necessary to issue a receipt or tax receipt as required by art. 2, c. 1, lett. oo of the D.P.R. 696/1996. Indirect electronic e-commerce, in fact, is assimilated, also for the purposes of VAT regulation, to mail order sales. It is not possible to issue invoices to private subjects inside Europe (i.e. those who do not have a valid European VAT number for intra-community trade) as Mapel & C. has adhered to the MOSS regime which requires VAT to be paid in the consumer's country. In the absence of specific communication by the purchaser at the time of purchase or in the absence of the information necessary for invoicing, the invoice will not be issued and the procedure will be carried out in accordance with the provisions for private subjects according to the DPR n. 633/72. In the case of orders performed by taxable persons VAT (Companies), the ordinary rules related to VAT invoicing as well as VAT territoriality are followed. For all foreign subjects (both VAT and private tax payers) not resident in the EU territory, the regulations on export sales apply: Mapel & C issues an invoice with no VAT tax, pursuant to article 8, first paragraph, letter a, of Presidential Decree no. 633/72.
4. Obligations of the purchaser
The Customer agrees and obligates, once the purchasing procedure is finished, to print and store these "Terms and Conditions", that he has already seen and accepted as obligatory step in purchasing and to print and storage the product-specifics, in order to satisfy the condition of the articles 3 and 4 of the Legislative Decree no 185/1999. It is forbidden to Costumer to enter false data, and/or invented, and/or of fantasy, in the procedure of registration required to activate the process for the execution of this contract and its further communications; the personal details and the email must be exclusively your personal data and of third persons, or fancy. It is expressly forbidden to make double registrations corresponding to a single person or insert data of third persons. It is responsibility of the customer, during registration and the "on line" purchase process, to communicate correct and updated personal, shipping and billing data for the execution of the contract. Once the purchase process is complete, since there is no obligation to produce invoice for not business customers within the European community, Mapel & C Srl will proceed with the issue of the fiscal receipt, except in the case where Mapel & C Srl receives an explicit request from the customer at the time of the order. Mapel & C Srl reserves the right to prosecute any violation or abuse, in the interest and for the protection of consumers.
5. Right of withdrawal
Within (and no later) 14 days from receipt of your order, send an email to email@example.com to request a return and wait for the confirmation.
In order to proceed, the product or the leather must not be used, cut or damaged. Otherwise it cannot be replaced/refunded.
Ship to this Address within 14 days
Once we have checked the package, your items can be replaced or you can request a refund.
In case of replacement, any surplus will be refunded, but the difference must be paid in advance before the new delivery.
Shipping costs for sending the return and sending the replacement product are paid by the customer.
In case of returns coming from outside of Europe, in the case a commercial invoice is required by the courier, provide a new proforma invoice with a symbolic value of 1€ (or 1$) , to avoid custom duties on return. Do not include a copy of the order or the original invoice. Contact us in case you need assistance.
Right of Withdrawal (detailed conditions)
The Customer has the right to withdraw from the purchase contract for any reason, without having to provide explanations and without any penalty. The withdrawal must be expressed by sending a registered letter with acknowledgment of receipt to the following address within 14 days of receipt of the goods to the following address: Mapel & C Srl, via Nazario Sauro n. 51, 56024, Ponte a Egola (Pisa) Italy (Download standard withdrawal form). The Customer cannot exercise this right of withdrawal for the same made-to-measure or clearly personalized products or products which by their nature cannot be returned or are liable to deteriorate or expire rapidly. Unless Mapel & C. has confirmed to collect the goods itself, the Customer must return the goods (also through an authorized third party), without undue delay and in any case within fourteen days from the date on which he communicated to Mapel & C. its decision to withdraw from the contract. Within the period of 14 days from the acceptance of the return, therefore, all the goods purchased intact and in their original packaging and any manuals must be returned to the sender-supplier, without any lack. The costs of returning the goods will be charged to the Customer as required by European legislation. Once the request is received, Mapel & C Srl will forward the full amount paid by the Customer within the term of (14) fourteen days from receipt of the returned goods. The Customer will promptly provide the bank details on which to obtain the reimbursement transfer (Cod. ABI, CAB, Current account, IBAN). The withdrawal right is however subject to the following conditions:
- The right applies to product purchased in its entirety; It is not possible to exercise withdrawal only on part of the purchased product.
- It is not possible to return customized or tailored products
- The purchased goods must be intact and returned in the original package, complete in all its parts (including packaging and any documentation and any ancillary equipment).
- Shipping, until the certificate of receipt in our warehouse is issued, is under the full responsibility of the Customer.
- In case of damage of the goods during transport, Mapel & C Srl will notify the Customer of the occurrence (within 10 working days from receipt of the goods in their warehouses), to let him make a timely complaint to the courier chosen by him and obtain a refund of the value of the property (if insured); in this case, the product will be made available to the Customer for its restitution, simultaneously eliminating the request for withdrawal.
- Mapel & C Srl shall not be liable in any way for damages or theft/loss of goods returned by uninsured shipments.
- Upon his arrival in the warehouse, the product will be examined to assess any damages or tampering not caused by transport; If the packaging and/or original packaging are damaged, Mapel & C Srl will withhold from refund due to a percentage of the value of the asset, however not exceeding 10% of the same, as a contribution to the costs of recovery.
- In case of returns coming from outside of Europe and in the case a commercial invoice is required by the courier, provide a new invoice with a symbolic value of 1€ (or 1$) , to avoid custom duties on return.
The right of withdrawal expires, for lack of an essential condition of good health (and/or its contents), in cases where Mapel & C Srl ensure:
- The non-diligent use of the good that he has compromised the integrity or the use of various consumables.
- The lack of external packaging and/or original internal packaging.
- The damage to the product for causes not concerning transportation.
In the case of forfeiture of the right to return, the goods will remain at & Mapel & C srl available for withdrawal.
6. Legal warranty
Taking into account the nature of the products sold, it should be noted that they are covered by the legal guarantee of conformity pursuant to art. 128 and following of the Consumer Code to which we refer (link). It should be noted that the Customer has no right to terminate the contract if the lack of conformity is only minor. Any defects or damage caused by accidental events or by the Customer's responsibility for use of the products that do not conform to their intended use or effect of normal wear and tear are excluded from conformity defects and, therefore, from the legal guarantee.
7. General conditions of use
The Customer is solely and solely responsible for the communication of information and incorrect data, fake or pertaining to third parties, without which they have expressed their consent. Finally, since each material will be downloaded or otherwise obtained through the use of the service of your choice and at your own risk, all responsibility for any damage to computer systems or loss of data resulting from unloading lies with the user and cannot be attributed to Mapel & C Srl. Mapel & C Srl declines any responsibility for eventual damages caused by inaccessibility to services featured on the website or from damage caused by viruses, damaged files, errors, omissions, service interruptions, deletions of content, network problems, or telephone provider and/or telematics means, such unauthorized access, data alterations, failure and/or malfunctioning of electronic equipment of the Customer. The Customer is responsible for the housing and proper use of your personal information, including credentials that allow you to access restricted services, as well as any harmful consequence or loss which might result against Mapel & C Srl or third parties as a result of incorrect use, loss, theft of such information.
8. Intellectual property rights
The contents of "Buyleatheronline.com", such as, but not limited to, works, pictures, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material in any format, including menus, web pages, diagrams, layouts, methods, processes, functions that are part of buyleatheronline.com, are protected by copyright. It is forbidden to reproduce, in whole or in part, in any form, "Buyleatheronline.com" content.
9. Trademarks and domain names
Mapel & C Srl is the exclusive owner of the logos and trademarks "Buyleatheronline.com", "BLO" and "Leather Online"; It is forbidden to use marks, to distinguish goods or services which are not similar to those of buyleatheronline.com or Mapel & C Srl. Any use of these trademarks does not in accordance with the law and, because unauthorized use is prohibited and will result in severe legal consequences. It is in no way allowed to use those trademarks and any other distinguishing feature on leather-online.it to take unfair advantage of the distinctive character or repute of these marks or in such a way as to harm them and their owners.

Mapel & C Srl has no responsibility for the accuracy and completeness of content published on its website. Mapel & C Srl, also, cannot guarantee its users that the web site will operate continuously, without interruptions and without errors or malfunctioning due to Internet connection. Mapel & C Srl has the right to terminate the contract by giving simple communication to the Customer with adequate and justified reasons; in this case, the Customer shall be entitled only of the reimbursement of any sum already paid.

Entering this website, the visitor, customer or user and Mapel & C. srl agree that the laws and the regulations of the Italian State will enforce any questions pertinent to the use of the website. Without prejudice to the application of the mandatory rules of European derivation for consumer protection, the General Terms and Conditions of Sale are governed by Italian law and in particular by the Consumer Code and by Legislative Decree 9 April 2003, n. 70 ("Implementation of Directive 2000/31 / EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce").
